These terms govern your use of Cardcature ("the Service"), accessed at cardcature.com. By using the Service you agree to these terms. If you don't agree, don't use it.
1. What Cardcature does
Cardcature lets you create personalised trading cards. You upload a photo, answer a few questions, and our AI generates stats, a special ability, and styling. You can download the result as a high-resolution image. We may add print-on-demand and other physical product options in future.
2. Eligibility
You must be at least 16 years old to use the Service. By using it you confirm you are.
3. Your content & the licence you grant us
Photos, names, descriptions and any other material you upload or type are "Your Content". You keep ownership of Your Content. By submitting it, you grant Cardcature a worldwide, royalty-free, non-exclusive licence to:
- Process Your Content to deliver the Service (including sending it to our AI providers).
- Store it for as long as needed to provide the Service or as set out in our Privacy Policy.
- Display the finished card back to you and let you download or share it.
We will not use Your Content for advertising or marketing without separate explicit consent.
You must have the right to upload the photo
By uploading a photo of a person, you confirm that:
- You took the photo, or you have permission from the person who did.
- You have permission from the person in the photo (or, if they're a minor, from their guardian) to upload their image and create a card.
- The photo doesn't depict illegal acts, abusive content, or anything that violates someone else's rights.
We may remove content or terminate accounts that violate these requirements at any time, with or without notice.
4. Acceptable use
You agree not to:
- Upload illegal content (CSAM, threats, content infringing third-party rights).
- Upload photos of public figures or celebrities to harass them or imply endorsement.
- Use the Service to harass, defame or threaten anyone (yes, even mates — keep the roasts in good faith).
- Reverse-engineer, scrape or attempt to gain unauthorised access to the Service or our infrastructure.
- Use the Service to train competing AI models on its outputs.
- Resell or redistribute the Service without our written permission.
5. AI outputs
The cards, stats, ability descriptions and image transformations are generated by AI based on your inputs. They may occasionally be unexpected, inaccurate or unsuitable. We don't guarantee any specific output. You are responsible for reviewing what the AI produces before downloading, printing or sharing it.
Outputs are unique to the inputs you provide. We make no claim of copyright on the output itself; you may use the cards you create for personal and non-commercial purposes. Commercial resale of generated cards is not permitted without separate agreement.
6. Our IP
The Service itself — the code, design, brand, frames, palettes, fonts and copy — is owned by Cardcature and protected by copyright and other intellectual property laws. You don't acquire any rights in it by using the Service.
7. Paid features
Some future features (e.g. printed cards, merchandise) may be paid. Pricing, refunds and delivery terms will be set out at the point of purchase. Until those features launch, the Service is free to use.
8. Service availability
We do our best to keep the Service running but we don't guarantee uptime. We may change, suspend or discontinue features at any time. We'll give reasonable notice for material changes that affect paying customers.
9. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that AI outputs will meet your expectations, be free of errors, or be appropriate for any particular use.
10. Limitation of liability
To the fullest extent permitted by law, Cardcature's total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you have paid us in the 12 months before the claim, or (b) £50.
We are not liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data, or business interruption — even if we have been advised of the possibility.
Nothing in these terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that can't be limited under applicable law.
11. Indemnity
You agree to indemnify Cardcature against any claim, damage, or cost (including reasonable legal fees) arising from Your Content, your breach of these terms, or your misuse of the Service.
12. Termination
You can stop using the Service at any time. We may suspend or terminate your access if you breach these terms or if we discontinue the Service. Sections that should reasonably survive termination (IP, disclaimers, liability, governing law) will survive.
13. Governing law
These terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales, except that you may bring claims in your home country if required by mandatory consumer protection law.
14. Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top reflects the latest version. Continued use after a change means you accept the updated terms.
